Terms of Service

Terms of Service

These Terms govern your access to and use of Yolo-Auto. By creating an account, generating an API key, using the API, or purchasing a subscription, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use Yolo-Auto on your own. If you are between 13 and 17, you may use the service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf. No one under 13 may use the service. We may terminate accounts operated by minors without the required consent, with no refund except where required by law.

2. The Yolo-Auto Service

Yolo-Auto provides an OpenAI-compatible API for model inference. We operate the model runtime ourselves rather than reselling a third-party model API. Requests may traverse or run on owned, leased, or rented infrastructure supplied by hosting, networking, and security vendors. Yolo-Auto is not a coding agent, IDE, automation framework, deployment tool, shell, package manager, professional service, or safety review service. The service provides API access to model responses; it does not itself execute code, operate your computer, deploy software, spend money, or take actions outside the API response.

Available models, routes, prices, limits, capacity controls, queue behavior, latency, and throughput may change over time. We may modify, suspend, or discontinue any part of the service for maintenance, security, capacity, hardware availability, legal, billing, or operational reasons. Public descriptions, examples, estimates, dashboards, and documentation are informational and do not create a service-level agreement, warranty, or promise of dedicated capacity.

3. Your Responsibility

You are solely responsible for how you use Yolo-Auto, your API keys, prompts, outputs, applications, systems, repositories, data, devices, third-party accounts, and any actions taken from or based on model output. You must review, test, and validate outputs before relying on them. You choose whether to connect Yolo-Auto to any software, tool, agent, workflow, account, system, or environment, and you accept all risk from that choice.

Model output is probabilistic and may be inaccurate, incomplete, offensive, unsafe, insecure, non-compliant, or unsuitable for your use case. Yolo-Auto does not guarantee that output is correct, secure, lawful, non-infringing, production-ready, or appropriate for any purpose.

4. Third-Party Tools, Agents, and Quickstart Examples

Yolo-Auto does not own, operate, control, endorse, or warrant any third-party coding agent, client, CLI, editor, extension, package manager, shell, automation tool, or other software you may use with the API. References to tools in documentation, install commands, examples, or quickstarts are provided only as convenience examples for users. They do not create any partnership, affiliation, sponsorship, agency, endorsement, commission, referral relationship, or revenue share between Yolo-Auto and those tools.

If you use a tool that can read files, write files, run commands, install packages, call APIs, edit code, commit changes, deploy software, access secrets, create cloud resources, make purchases, or otherwise act in your environment, you are solely responsible for configuring, supervising, approving, auditing, and securing that tool. Yolo-Auto is not responsible for tool behavior, tool bugs, supply-chain issues, data loss, security incidents, unintended changes, costs, outages, deployments, legal exposure, or any other consequence of using a tool with Yolo-Auto output or API keys.

You should inspect any command, script, installer, dependency, or configuration before running it. Quickstarts are examples only and are not a representation that a third-party tool is safe, suitable, maintained, or error-free.

5. Accounts and API Keys

You are responsible for your account credentials, sessions, API keys, and all activity under them. Keep API keys secret, use reasonable security controls, and promptly disable or rotate keys you believe are compromised. Account sharing is not allowed. Your account, subscription, sessions, and API keys are for your own use only. You may not sell, share, sublicense, loan, pool, resell, or transfer access except as permitted by us in writing.

Each person, business, household, team, or coordinated operation may maintain only one account unless Yolo-Auto approves additional accounts in writing. You may not create, control, fund, coordinate, or use multiple accounts, identities, subscriptions, or projects to combine capacity, evade limits, operate a shared or downstream service, or obtain access beyond one account's limits. This prohibition applies even when separate names, sign-in providers, email addresses, payment methods, API keys, or subscriptions are used.

6. Acceptable Use and Prohibited Content

You may not use Yolo-Auto to create, request, transform, possess, transmit, promote, facilitate, or assist with:

  • Child sexual exploitation: child sexual abuse material (CSAM); sexual or exploitative content involving a person under 18 or represented as under 18, whether real, simulated, illustrated, or computer-generated; grooming, enticement, sextortion, sexual trafficking, or instructions that facilitate abuse of a minor.
  • Non-consensual sexual content: intimate imagery shared or generated without consent, sexual deepfakes, voyeuristic content, sexual extortion, or content that facilitates sexual violence, coercion, exploitation, or trafficking.
  • Violence and serious wrongdoing: credible threats, targeted harassment, terrorism, violent extremist activity, or instructions intended to enable murder, kidnapping, torture, human trafficking, or other serious violent crime.
  • Cyber abuse and fraud: malware, ransomware, phishing, credential theft, unauthorized access, destructive attacks, evasion of security controls, identity theft, scams, spam, or financial fraud.
  • Privacy and rights violations: doxxing, unlawful surveillance, exploitation of highly sensitive personal data, infringement of intellectual-property or privacy rights, or content you do not have the right to process.
  • Other illegal or abusive activity: illegal weapons or controlled-substance trafficking, multiple-account operation, attempts to bypass service limits, attacks or probes against the service, or any use that violates applicable law, harms others, or creates material risk for Yolo-Auto, its users, or third parties.

Good-faith discussion, prevention, reporting, moderation, or safety analysis is permitted only when it does not include, reproduce, solicit, or facilitate prohibited material or conduct. Do not submit prohibited material to test filters or claim a research exception.

We are not required to proactively monitor every request. If we become aware of suspected prohibited conduct, we may block content, preserve relevant data, suspend or terminate access, and report or disclose information to the National Center for Missing & Exploited Children, law enforcement, regulators, hosting providers, or other appropriate parties when required or permitted by law. Apparent child sexual exploitation may be reported without prior notice. Unlimited access is not a license for abuse.

7. Fair Use, Concurrent Units, and Queues

Your use of Yolo-Auto must not unreasonably impact the experience of other users. This includes automated abuse, attempts to degrade performance or availability for the broader community, or any behavior that creates risk for the service or other users.

All inference hardware has finite memory and throughput. To ensure fair access, Yolo-Auto may assign scheduler priority during periods of high demand based on recent usage. Token usage is unlimited for plans described as unlimited: we do not bill by token or impose a plan token-volume cap. Unlimited does not mean unlimited simultaneous work, dedicated hardware, guaranteed throughput, guaranteed latency, unlimited context, or an unlimited queue.

Each plan has a concurrent-unit budget shared across the project's API keys. We estimate request size from the submitted input, including messages and other prompt material such as tool schemas and response formats. Unless the current pricing or documentation states otherwise, estimated prompts up to 32K tokens reserve 1 unit, above 32K through 96K reserve 2 units, above 96K through 160K reserve 3 units, and above 160K reserve 4 units. A request's cost is capped at the project's total budget so a one-unit plan can submit one request up to its permitted context limit. Units remain reserved until the request completes, fails, expires, or is canceled, including while output is generated or streamed. Estimates, boundaries, and accounting may differ from a model tokenizer and may be corrected or changed prospectively as the service evolves.

If enough units are unavailable, a request may enter a bounded project queue. Queue admission, length, ordering, polling, and timeout are capacity controls, not guaranteed reservations. Queued requests may wait, time out, be canceled when the client disconnects, or be rejected when the queue is full. Clients are responsible for maintaining their connection, setting suitable timeouts, handling HTTP 429 and other documented errors, and retrying safely. Yolo-Auto may change queue settings or bypass, pause, or clear queues for maintenance, incidents, abuse prevention, deployment, or capacity protection.

8. User Content and Data

You retain your rights to prompts, inputs, outputs, and other content you submit. Yolo-Auto does not claim ownership of your content. You grant Yolo-Auto the limited rights needed to transmit, process, secure, debug, operate, and improve the service; comply with law; and enforce these Terms. We do not intentionally train models on your prompts or responses.

Requests are processed by model runtimes we operate across distributed machines, including infrastructure we may own, lease, or rent. We do not resell access to a third-party model API. Hosting, networking, security, authentication, and payment vendors may process data as needed to provide their supporting services.

9. Plans, Billing, and Subscriptions

Paid subscriptions renew automatically until canceled. Users may pay for a recurring subscription using a payment card or make a one-time stablecoin payment through Stripe. Yolo-Auto does not store card numbers or crypto-wallet credentials. You authorize recurring charges when you choose a subscription. A one-time stablecoin payment grants 30 days of access to the selected plan from Checkout creation, does not renew, and requires another payment after access expires. You can manage or cancel paid subscriptions through the billing portal when Stripe billing is enabled. If you cancel a paid subscription, you keep paid-plan access through the end of the billing period you already paid for; after that period ends, your account may return to Free or lose paid-plan access.

A subscription purchases access to the plan and concurrent-unit budget described by Yolo-Auto, not ownership or exclusive use of servers, GPUs, memory, bandwidth, queue positions, or model capacity. Multiple API keys on one project share that project's limits. Plan limits and fair-use controls may include request-size-based unit costs, context and output limits, bounded queues, timeouts, scheduler priority, rate limits, and temporary capacity restrictions. These controls apply even when request or token volume is described as unlimited.

The current billing period's subscription charge and one-time stablecoin payments are non-refundable, including if you stop using the service before paid access ends; future subscription renewals can be canceled at any time through the billing portal when Stripe billing is enabled. Unless required by law or expressly stated otherwise, payments are non-refundable and service interruptions, queue waits, latency, throughput changes, or unused capacity do not create credits or refunds. We may change plans, prices, features, models, unit formulas, queue settings, or limits prospectively. We will post material changes and may require renewed acceptance. If you do not agree to a change, your remedy is to stop using the service and cancel before a future renewal.

10. Availability and Support

The service is provided on a best-effort, shared-capacity basis unless a separate written agreement signed by Yolo-Auto says otherwise. We do not guarantee uninterrupted availability, queue admission, request completion, specific latency, specific throughput, scheduler priority, model uptime, hardware availability, compatibility with any tool, or that any route, model, limit, or feature will remain available. No service-level agreement or service credit applies unless we expressly agree to one in a separate signed writing.

We are not responsible for delay or failure caused by events beyond our reasonable control, including internet or power failures, network attacks, upstream infrastructure, Cloudflare or Stripe outages, hardware failure, model defects, government action, labor disputes, natural disasters, or emergency maintenance.

11. Disclaimers

Yolo-Auto is provided "as is" and "as available." To the maximum extent permitted by law, Yolo-Auto and its operators disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, security, compatibility, and uninterrupted or error-free operation.

You use the service, model outputs, examples, documentation, quickstarts, and any connected tools at your own risk. You are solely responsible for decisions, actions, omissions, systems, software, data, losses, and costs arising from your use of Yolo-Auto or any tool used with it.

12. Limitation of Liability

To the maximum extent permitted by law, Yolo-Auto and its operators will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, lost revenue, lost savings, lost data, loss of goodwill, business interruption, security incidents, data corruption, deployment failures, code defects, third-party tool actions, queue delay, rejected or incomplete requests, or costs of substitute services.

To the maximum extent permitted by law, the total aggregate liability of Yolo-Auto and its operators for all claims arising out of or relating to the service or these Terms will not exceed the greater of 100 US dollars or the fees you paid to Yolo-Auto during the three months immediately before the event giving rise to the first claim. These exclusions and limitations apply regardless of the legal theory, whether or not a remedy fails of its essential purpose, and whether or not we were advised that damages were possible. They do not limit liability that cannot lawfully be excluded or limited.

13. Indemnity

You agree to defend, indemnify, and hold harmless Yolo-Auto and its operators from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the service, your content, your API keys, your applications, your connected tools or agents, your violation of these Terms, or your violation of law or third-party rights.

14. Termination

You may stop using Yolo-Auto at any time. We may suspend or terminate your account and access for violations of these Terms, abuse, fraud, creating risk for the service or others, failure to pay, legal requirements, hardware or capacity constraints, security incidents, or operational needs. Except where required by law, no refund is due when access is suspended or terminated for cause. If we terminate a paid subscription without cause before its paid period ends, your sole remedy is a prorated refund for the unused portion of that period. Sections intended to survive termination will continue to apply.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted here with a new effective date, and we may require you to affirmatively accept it. We will provide notice of material changes when reasonably practicable. Continued use of Yolo-Auto after changes become effective, or affirmative acceptance when requested, means you accept the updated Terms. If you do not agree, you must stop using the service and cancel any future renewal.

16. Disputes and General Terms

Yolo-Auto is operated from the United States. The service and these Terms are subject to applicable United States federal law and applicable state and local laws. You are also responsible for complying with laws applicable where you access or use the service.

Before filing a claim, you agree to send a written description of the dispute to support@yolo-auto.com and allow 30 days for informal resolution, except where immediate injunctive relief is reasonably necessary. To the maximum extent permitted by law, any claim arising from the service or these Terms must be filed within one year after it arose or it is permanently barred.

These Terms, together with the Privacy Policy and any plan terms presented at purchase, are the entire agreement about the service and replace prior discussions or representations on that subject. If any provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them as part of a merger, acquisition, financing, reorganization, sale of assets, or transfer of the service. These Terms do not create an employment, agency, partnership, joint venture, fiduciary, franchise, or third-party-beneficiary relationship.
